The Covid-19 pandemic has accelerated new forms of work, such as international employee relocations. This phenomenon directly impacts fiscal and labor aspects, influencing the tax and labor costs associated with an employee’s relocation.

If you reside and work in Spain, you will be subject to income tax in Spain, as well as taxes on your assets, and you must file a Spanish tax return. Depending on your residency status, you may be required to pay taxes on your global income or only on income earned in Spain. If you are considered an official Spanish resident, you will pay IRPF (Personal Income Tax) on all your income. If you are not a resident, you will only pay taxes on income generated in Spain.

What is an Expatriate and How Is Their Tax Situation Considered? How Is an Expatriate Taxed in Spain?

A person is considered a tax resident in Spain if they meet any of the following criteria:

  1. Reside in Spain for more than 183 days a year, even if they are not consecutive.
  2. Have their main base of activities or economic interests in Spain, either directly or indirectly.
  3. It is presumed, unless proven otherwise, that a taxpayer has their habitual residence in Spain if their legally non-separated spouse and minor children habitually reside in Spain.

In any of these cases, the expatriate is considered a tax resident in Spain and has tax obligations with the Spanish authorities.
